This guy is using Maya for this project. He uses a sine wave which is then controls the position of the nodes that control the bones which are skinned to the fish. Is there a 3dsmax equivalent?
I tried using the WAVE spacewarp which, when attached to the point nulls controls them nicely but for some reason the underlying vertices that the nulls were controlling (when using a spline IK solver) doesn't have any effect on the spline. It's very odd.
