We own the trademark and we've been through some fights with Symantec who tried to register it too - so far, unsuccessfully. We don't have resources to go after them for the actual usage of the word though, even though they know that using it is illegal.

I find often, legal battles can be more expensive then the initial loses. It only makes sense to take legal actions if there are millions to be made (in my opinion). Seen too many people waste fortunes just to prove "right".

We had a local Pizza franchise with the same name as an international Hotel/Casino. I can't remember the details as it was a long time ago but it was something like the pizza place was forced to change their name.

The pizza place's marketing people however took advantage of this and launched a very successful add campaign "We're so cheap, we can't even keep our name"

easy fix. Wrote some code, to crawl their web server, and hyperlink the word, "V-Ray" to your homepage.
