    As I model I would like to model in 3D space and turn the enclosed spline into a poly, but it doesn't work. When I am in elevation it works... I am I doing something wrong? What I am trying to do is draft over existing geometry in perspective, delete the old geometry, and turn thenew into faces.

    maybe it's a problem with snaps in 2/2.5d vs 3d...sounds like some verts aren't closing/welding when you're drawing in 3d view...I should learn more, but I seem to have a better time drawing closed shapes in orthogonal views.

      there is a bug with splines. splines should always be created with 2.5d snap and in the top view, if possible. otherwise extrusion wont work as expected, or meshing fails.

        this has to do with the "pivot" of the spline. Can be fixed on existing splines by creating a spline in the right view (doesnt have to be top view, can be the view you want to extrude to) and attaching your spline to it. Then delete the elements newly created and it should work.

        What you are planning is not working per se. A 3D spline cannot be correctly converted toa curved surface unless you give it some more info by doing proper patch or nurbsmodelling. If you're trying to re-topologise an existing mesh then there's polytools (wich is integrated with 2010) or standalone tools to draw polys on top of meshes instead of splines.
