I got it to work by writing a dummy file to the directory. So if i was writing to file Shot03_.png, i would just make a file called that and put it in that directory, even though the render ends up writing file Shot03_0001.png, it removes the error. Not sure what is going on but it seems to be a mix up internally. I am also curious if it could be related to Vray Frame Buffer. I am using that to separate my passes into folders. I made the VRFB also point to the same file as in the Max output section to avoid the "no output" error. It writes twice as many files but I just delete the ones not written by vray into the folders. Seems silly, but backburner is useless to VRay unless I do this.
