refraction fog problem...

I have problem with strange line when using refraction with fog with affect shadows on.

I have ice cream(white ice cream with chocko on top that has refraction and fog. when affect shadow is on i have this strange line around


when off
it's okay but I affect shadow is producing more realistic refraction so I would prefer to use it but how to get rid of this tiny black border?

Isn't this the same irritating shadow line that we all get with SSS2 when meshes intersect? I always get the same issue with water bodies where they intersect land or objects.
