proxys and display layers

I seem to have an issue with adding proxy's to display layers.
I can add them to a layer fine but when you turn off the layer they are still visible and still selectable.

Anyone else have this issue?

Ignore post It was to do with the grouping, just selecting top group didnt work but lower nested groups worked.
