Exactly; different models have different licenses.
Speaking personally, I am using it to replace some foliage and improve people in some images.
I am, with TyDiffusion, simply using my own scenes or quickly built proxy shapes from which to generate ideas based on prompts.
I keep those prompts very general, mentioning no other artist's style or inspiration.
So that's my caveat and I am happy with it, unless someone can argue that that alone is somehow illegal or an abuse of the open source models in some way.
There's a lot to learn here, and things are evolving very quickly, so I'm happy to be schooled to any degree
