  • Selling my Gnomon DVD's

Hey Guys just wanted to let you all know that I am selling my collection of Gnomon DVD"S over at Amazon. I have viewed most of them a couple of times so they are all in great condition.

I am selling them at a good rate, for example Global Illumination: Interiors (V-Ray Lighting Techniques with Christopher Nichols) is $78 with shipping on the Gnomon website. I am selling it for $48 with shipping.

Also if anybody wants to make an offer on the full bundle, pm me.

There is a list of the DVD's over at Amazon (Seller name=Rendertime):

Of course, I bought them which means I can sell them. They are DVD's not software.

        http://www.thegnomonworkshop.com/terms.html

You agree not to copy, republish, frame, download, transmit, modify, adapt, create derivative works based on, rent, lease, loan, sell, assign, distribute, display, perform, license, sublicense or reverse engineer the Site, Materials or Services, any portions of the Site, Materials or Services or the selection and arrangement of the Site, Materials or Services, except as expressly authorized herein. In addition, you agree not to use any data mining, robots or similar data gathering and extraction methods in connection with the Site, Services or Materials.
Theyre not getting any money from you selling the dvds, so to them it's the same as piracy for all the good it does. Its not software, but it's got a very similar license.

          Bit more info for you:

The First Sale Doctrine of Copyright Law

The first sale doctrine allows purchasers of copyrighted material to sell that which they have purchased without violating the copyright laws. The theory here is similar to that of the exhaustion doctrine in patent law. The copyright owner must derive all revenue from the so-called first sale, and cannot control the future disposition of the article originally sold.

The key to understanding the first sale doctrine is to know that the copyright owner only has right to prevent others from copying and distributing (for free or for profit) copies of a work covered by a valid copyright.

btw, those are the terms for the web site content... precedent is pretty clear that you are allowed to sell used cd, tapes, dvd's etc. Unless they have some sort of eula that states otherwise on the dvd itself it should be allright.

Re-render, did you read them? It even says that it's not in the bit that I quoted.
              the Site, Materials or Services,
              It's for anything they do.

I dont even care what the hell you do with the dvd's, it's just you're actually not allowed to sell them and that terms and conditions does cover the dvds.

Thanks for smearing my post with the p word. I have spent thousands on training DVD's, if I want to sell them to get new ones that is my choice, maybe you should actually worry about people who pirate material like this instead of questioning my legitimate sale. Gnomon make the best training DVD's out there and I will continue to use them as a source of knowledge.

What law does it fall under?

I dont care what you do, and i'm not really bothered by any of it - and never tried to smear it.

You just got really defensive and I thought i'd point that he was actually right.

                      I read it this way

display, perform, license, sublicense or reverse engineer the Site, Materials or Services, any portions of the Site, Materials or Services or the selection and arrangement of the Site
The other section on software may cover it? but calling video software is a stretch, IMO

Never tried to smear it, I am making a legitimate sale and you throw about "so to them it's the same as piracy for all the good it does".

Tell me which law you are talking about if you feel he is right.

...The 2 words after the part you bolded says it includes the materials and services they offer?? Did you just turn your brain off for 5 words after you read each time it said site? That covers everything they produce.

Your obviously itching for an argument, I on the other hand have to work so I can buy some more of those fantastic training DVD's, maybe you should do the same. I will leave you to argue with yourself.
