have now loaded up max and its showing as in use on the computer im on...BUT im still getting that bloody Could not obtain a license (-9 error

The issue is that you have borrowed only the GUI (Interface) license and not the render node. In order to use V-Ray for 3ds Max, you need to borrow both the Render node and Interface license - just like you have borrowed the Interface and Simulation license for Phoenix.
I have released your license from our side of the servers, please borrow it again but this time borrow both the Interface and render node.
