          I know, I was starting to wonder if I was imagining all this. That it had been flagged that my sale was piracy in their eyes, that I researched it and posted the results of the laws . Still wasn't enough, contacted Gnomon, got a reply, still wasn't enough and now I am called a liar. I really don't know what else to do.

              Just got a reply Gnomon after asking permission to post his e-mail and he said I could go ahead. Hope this finally clears everything up and we can put this to rest.

                  LOL This thread is full of win and I'm not even involved this time around.

                  Honestly, I see everyone's point of view. There are a lot of terms that prevent most people from reselling DVDs. I give credit to Tartan for spending the money and purchasing all this training material in the first place. I also give him credit for openly posting his selling here. I could also see why once he used them, it's like selling a used book which you will probably never read again.

                  I have a small story - similar in some ways. When Halo 3 came out for the Xbox, I bought it on hype. The store (Best Buy) only had the collectors edition available so I grabbed that for more money. I actually played it for a couple days thinking it would get better but it didn't. I thought the game was absolute garbage.

                  I went back to return it saying I wanted my money back but they refused. Apparently, there's no return policy on games other than exchanges - in particular this is left-over from rampant piracy on PC games/Mod chipping. To be honest, I wouldn't even know (or even if it was possible) where to begin copying an Xbox DVD...

                  I suppose the issue here is whether a DVD is like a used book or more like a video game. I have to give the folks over at Gnomon a lot of credit for this one.

                    OK so I suppose it is safe to say that cubiclegangster wont be puttin in an offer on these DVD's
                    (although if the price is right- who knows????)

                      at least in europe it's legal to sell used software, books, etc, regardless of the EULA, because EULA´s don't really have a legal impact here. it's hard to enforce them in court.
                      that's why we can buy microsoft windows OEM versions here in stores, legally.

                          I just wish i didn't have to read six pages to figure out that it was alright by Gnomon. It was somewhat entertaining though....throw in a gun fight and a car chase and i'm good for another six!
